Uhh...yes you can fail a breathalyzer with this. In fact, if it has any effect on changing breathalyzer results, you are probably much more likely to as the alcohol is entering your system through your lungs, which is the same organ that expels air! You've got to be an idiot if you think you can't fail a breathalyzer off of this thing.

Every thing you've heard about faking breathalyzers is inaccurate. Certain things can affect it, but mostly things you can't control (humidity, air temperature), and they effect it only slightly. The breathalyzer does not rely on smell, so even if you've covered up you breath with peanut butter, a penny, etc., it doesn't matter..the machine detects alcohol molecules, some of which are naturally respirated out. The peanut butter and penny thing may help you avoid getting to the point of taking a breathalyzer test, however if the cop doesn't notice the smell of alcohol.

If you get a good enough lawyer though, they can convince the jury that these things aren't accurate to the point of scientific precision. But that is quite different from affecting the results, however erroneous they might be.
